Here is the New Kingdom Downgrade Process that was Approved at the Gathering of the Clans 2014.

Kingdom Downgrade Proposal

01-JUL-2014 -- Clan 2014

An alteration to the Circle of Monarchs Bylaws to provide a framework by which the Circle of Monarchs may initiative a process of downgrade kingdoms.

The following language will be added to Article V, Section 2 of the Circle of Monarchs Bylaws after Article V, Section 2-b.

c. May forward a kingdom to the Amtgard, Inc. Board of Directors for demotion. Reasons for demotion can include contractual issues or failure to function as a kingdom of Amtgard. The Executive Committee may reject obvious inappropriate demotion proposals. A proposal for a kingdom to be considered for demotion must be approved by the Executive Committee, must contain sufficient information for the Circle of Monarchs to make a decision, and must be on the agenda for three months prior to the vote. An affirmative vote shall be finalized after the kingdom in question has been granted 30 days to respond and the Executive Committee determines that the matter shall proceed. Amtgard, Inc. retains final authority regarding whether a kingdom shall be demoted.

Current Process, including any checks and balances

In the current process, the Circle of Monarchs has a role in determining whether a kingdom may be promoted, but no explicit role in determining whether a kingdom may be demoted. This means the Circle of Monarchs can simply ask, by majority vote, for the Amtgard, Inc. Board of Directors to consider a kingdom for demotion. This item can be added to the agenda at any time, or even brought up as an impromptu vote at a regular meeting.

Proposed Process, including any checks and balances

In the proposed process, the Circle of Monarchs would put the following steps in place for how it handles demotion proposals:

1. The Executive Committee must approve adding the topic to the agenda. (This is similar to the current process, but more strongly worded here.)
2. The proposal must contain enough information for the Circle of Monarchs to make a decision. For example, if it is proposed that the Kingdom of Badassdom be demoted because regular attendance across all parks has dropped to 12 (which may or may not be a valid reason for demotion—this is just a hypothetical example), the proposal must contain evidence such as sign-in sheets or ORK data. (There is no requirement for documentation in the current process.)
3. The proposal must be on the agenda for three months before a vote can occur. (Demotion proposals may be brought up and voted on immediately in the current process.)
4. The proposal must receive 75% approval to pass. (Demotion proposals just require a majority vote in the current process.)
5. The kingdom being discussed is given 30 days to respond. (There is no such provision in the current process.)
6. After that, the Executive Committee makes a second determination regarding whether the matter should proceed. (There is no such provision in the current process.)
7. If a demotion proposal passes all those steps, then the Executive Committee asks Amtgard, Inc. to add the proposal to their agenda at their next meeting. The kingdom is still not demoted—it is up to Amtgard, Inc. whether to finalize the demotion.

Note that Amtgard, Inc. retains all authority to handle emergency situations that require a faster solution.
